Welcome to Quiltable! These Terms of Service ("Terms") govern your access to and use of Quiltable's website, mobile applications, and related products and services (collectively, the "Services"). Please read these Terms carefully before using Quiltable.

By creating an account, downloading our mobile application, purchasing a subscription, or otherwise accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use Quiltable.

Our Philosophy

Quiltable was created because quilting should feel creative, not overwhelming.

We believe your fabric should be easy to find, your projects should be easy to manage, and your tools should support your creativity instead of getting in the way.

Our goal is to help quilters spend less time searching through bins and more time creating quilts they love.

While this philosophy is not a legal promise or warranty, it reflects the principles that guide how we design, improve, and support Quiltable.

1. Definitions

Throughout these Terms, the following words have the meanings below:

  • "Quiltable," "we," "our," or "us" means Quiltable and its owners, operators, employees, contractors, successors, and affiliates.
  • "Services" means the Quiltable website, mobile applications, software, calculators, content, features, subscriptions, and any related services we provide.
  • "User," "you," or "your" means any individual or organization accessing or using the Services.
  • "Account" means the user account you create to access Quiltable.
  • "Content" includes photographs, project information, notes, fabric inventories, comments, text, images, files, and any other information uploaded, created, or stored within Quiltable.
  • "Subscription" means any paid membership or premium feature offered through Quiltable.

2. Eligibility

You must be at least 13 years old, or the minimum legal age required in your jurisdiction, to use Quiltable.

If you are under the age of majority in your jurisdiction, you may only use Quiltable with the permission and supervision of a parent or legal guardian.

By using Quiltable, you represent and warrant that you meet these eligibility requirements.

3. Your Account

You may need to create an account to access certain features of Quiltable.

You agree to:

  • Provide accurate and complete registration information.
  • Keep your email address and account information up to date.
  • Maintain the confidentiality of your password.
  • Be responsible for all activity that occurs under your account.
  • Notify us promptly if you believe your account has been accessed without authorization.

You may not create an account using false information or impersonate another individual or organization.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or abusively.

4. Your Content

Quiltable is built around the information you choose to store. This may include fabric photos, fabric inventory, yardage information, projects, quilt plans, calculator results, notes, tags, storage locations, and other quilting-related information.

You retain ownership of the content you upload to Quiltable.

These Terms do not transfer ownership of your photos, project information, or other content to Quiltable.

However, by uploading or storing content within Quiltable, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit, and display your content solely as necessary to operate, maintain, secure, improve, and provide the Services.

This license ends when your content is permanently deleted from our systems, except to the extent we are required to retain certain information for legal, security, fraud prevention, or backup purposes.

5. Your Responsibilities

You are responsible for the content you upload and for ensuring that you have the legal right to use it.

You agree that you will not upload content that:

  • Violates another person's intellectual property rights.
  • Contains unlawful, defamatory, abusive, threatening, or fraudulent material.
  • Contains malicious software or code.
  • Violates any applicable law or regulation.

Quiltable does not routinely review user content but reserves the right to remove content that violates these Terms or applicable law.

6. Privacy

Your privacy is important to us.

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Quiltable, you acknowledge that you have reviewed our Privacy Policy and understand how your information is handled.

7. Changes to the Services

Quiltable is an evolving platform.

We may add, modify, improve, suspend, or discontinue features, tools, subscriptions, or functionality at any time in order to improve the Services, comply with legal requirements, maintain security, or support future development.

While we strive to minimize disruption, we do not guarantee that every feature will remain available indefinitely.

We will make reasonable efforts to communicate significant changes when appropriate.

8. Subscriptions and Paid Memberships

Quiltable offers both free and paid subscription plans. Paid plans may include additional features, increased storage limits, expanded project capacity, premium tools, or other benefits described within the Services.

Subscription features, limits, and pricing may change over time as Quiltable continues to evolve.

Descriptions of current plans are available within the Quiltable app and on our website. If there is a conflict between promotional materials and these Terms, these Terms will govern.

Unless otherwise stated, subscriptions are personal to the account holder and may not be shared, transferred, resold, or assigned.

9. Billing and Renewals

If you purchase a subscription through the Apple App Store, Google Play Store, or another authorized marketplace, your purchase is processed by that marketplace and is subject to its payment terms and conditions.

Subscriptions automatically renew unless canceled before the renewal date.

You are responsible for managing your subscription through the marketplace from which you purchased it.

Quiltable cannot cancel, modify, refund, or manage subscriptions purchased through Apple or Google. Requests regarding billing, refunds, or subscription management must be directed to the applicable marketplace.

If Quiltable later offers subscriptions purchased directly through our website, those purchases may be governed by separate payment terms presented at the time of purchase.

10. Free Trials and Promotional Offers

From time to time, Quiltable may offer free trials, promotional pricing, introductory offers, or limited-time discounts.

Unless otherwise stated:

  • Offers may be available only to new subscribers.
  • Offers may not be combined with other promotions.
  • Offers may be modified or discontinued at any time.
  • Eligibility is determined by Quiltable in its sole discretion.

At the conclusion of any free trial, your subscription may automatically convert to a paid subscription unless canceled before the trial ends, subject to the rules of the applicable app marketplace.

11. Founding Member Memberships

Quiltable may offer a limited Founding Member membership in recognition of early supporters.

Founding Member memberships may include lifetime access to certain subscription features, recognition within the Services, commemorative badges, or other benefits described at the time of purchase.

Founding Member status does not provide ownership in Quiltable, voting rights, equity, profit sharing, advisory authority, or any other ownership interest in the company.

Unless expressly stated otherwise at the time of purchase, Founding Member benefits apply only to the individual account that completed the purchase and may not be transferred, resold, inherited, or assigned.

Quiltable reserves the right to introduce new subscription tiers, features, and services in the future. While we intend to honor the core benefits promised to Founding Members, new products or premium services introduced after purchase may not automatically be included unless specifically stated.

12. Feature Availability

Features available within Quiltable may differ based on your subscription level, platform, device capabilities, geographic location, or technical limitations.

Some features may be released gradually, offered only during beta testing, or made available to specific groups of users.

Quiltable makes no guarantee that every feature will be available on every device or operating system.

13. Acceptable Use

You agree to use Quiltable only for lawful purposes and in accordance with these Terms.

You agree that you will not:

  • Use Quiltable in violation of any law or regulation.
  • Attempt to gain unauthorized access to our systems or another user's account.
  • Interfere with or disrupt the security, stability, or operation of the Services.
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code of Quiltable except where expressly permitted by applicable law.
  • Use bots, scripts, automated tools, or scraping technologies to access or copy the Services without our written permission.
  • Upload malicious software, viruses, ransomware, or other harmful code.
  • Circumvent subscription limits or security measures.
  • Use Quiltable in a way that could damage, disable, overburden, or impair the Services.
  • Impersonate another individual or falsely represent your affiliation with any person or organization.

Violation of these provisions may result in suspension or termination of your account.

14. Intellectual Property

Except for content owned by users, all rights, title, and interest in the Quiltable Services are owned by Quiltable or its licensors.

This includes, but is not limited to:

  • The Quiltable name and branding.
  • Logos and trademarks.
  • Software and source code.
  • User interface design.
  • Graphics and illustrations.
  • Written content.
  • Calculators and planning tools.
  • Documentation.
  • Original educational materials.

These materials are protected by copyright, trademark, trade secret, and other intellectual property laws.

Nothing in these Terms grants you ownership of Quiltable's intellectual property.

You may not reproduce, modify, distribute, sell, license, or create derivative works from any portion of the Services without our prior written permission, except as permitted by applicable law.

15. Feedback

We love hearing ideas from our community.

If you submit suggestions, feature requests, comments, bug reports, or other feedback, you agree that Quiltable may use, modify, implement, publish, or incorporate those ideas without compensation or obligation to you.

This allows us to continue improving Quiltable for the quilting community while avoiding uncertainty regarding ownership of future product improvements.

16. Suspension and Termination

You may stop using Quiltable at any time.

We reserve the right to suspend or terminate access to the Services if we reasonably believe:

  • These Terms have been violated.
  • Your account presents a security risk.
  • Your use harms other users or the Quiltable platform.
  • We are required to do so by law.

Termination does not relieve either party of obligations that arose prior to termination, including outstanding payment obligations where applicable.

17. Quilt Calculators and Planning Tools

Quiltable includes calculators and planning tools intended to assist with quilting projects, including fabric estimates, quilt dimensions, block calculations, and other planning resources.

While we strive to provide accurate calculations, these tools are intended as planning aids only and should not be relied upon as the sole basis for cutting fabric or constructing a quilt.

Fabric shrinkage, seam allowances, pattern instructions, manufacturer variations, user input, and other factors may affect actual results.

You are responsible for reviewing calculations and verifying measurements before cutting fabric or beginning a project.

18. AI-Assisted Features

Certain Quiltable features may use artificial intelligence, machine learning, image recognition, or automated analysis to assist with identifying fabrics, colors, patterns, or other quilting-related information.

These features are designed to assist you but are not guaranteed to be accurate, complete, or error-free.

You acknowledge that AI-generated results may occasionally be incorrect and should be independently verified before relying upon them.

Quiltable continually improves these features but does not warrant that automated suggestions will always identify fabrics or quilting information correctly.

19. Third-Party Services

Quiltable relies on third-party providers to deliver certain portions of the Services, including cloud hosting, authentication, payment processing, analytics, email delivery, notifications, and mobile application distribution.

Your use of those third-party services may also be governed by their respective terms and privacy policies.

Quiltable is not responsible for the availability, accuracy, or practices of third-party services that are outside of our reasonable control.

20. Beta and Experimental Features

From time to time, Quiltable may offer beta, preview, early access, or experimental features.

These features may be incomplete, contain bugs, change significantly, or be discontinued without notice.

Beta features are provided to help us improve Quiltable and may not meet the same performance or reliability standards as generally available features.

21. Service Availability

We work hard to keep Quiltable available and reliable.

However, we cannot guarantee uninterrupted or error-free access to the Services.

Maintenance, software updates, internet outages, hardware failures, security incidents, and circumstances beyond our reasonable control may temporarily affect availability.

We reserve the right to perform maintenance, implement updates, and modify the Services as necessary.

22. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUILTABLE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, OR FREE FROM INTERRUPTIONS.

NO INFORMATION PROVIDED BY QUILTABLE CREATES ANY WARRANTY UNLESS EXPRESSLY STATED IN WRITING.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUILTABLE AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES ARISING FROM OR RELATED TO YOUR USE OF QUILTABLE.

TO THE EXTENT PERMITTED BY LAW, QUILTABLE'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:

  • ONE HUNDRED U.S. DOLLARS (US $100), OR
  • THE AMOUNT YOU PAID TO QUILTABLE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, SOME OF THESE LIMITATIONS MAY NOT APPLY.

24. Indemnification

You agree to defend, indemnify, and hold harmless Quiltable and its owners, employees, contractors, affiliates, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of:

  • Your use of the Services;
  • Your violation of these Terms;
  • Your violation of another person's rights;
  • Your content uploaded to Quiltable; or
  • Your violation of applicable law.

25. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles.

Unless prohibited by applicable law, any legal action arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of those courts.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Services, applicable law, business practices, or for other operational reasons.

When we make material changes, we will update the Effective Date shown at the top of these Terms and, where appropriate, provide additional notice through the Services or by email.

Your continued use of Quiltable after updated Terms become effective constitutes your acceptance of those revised Terms.

27. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

28. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.

29. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented in connection with specific Services, constitute the entire agreement between you and Quiltable regarding your use of the Services.

They supersede all prior agreements, understandings, and communications relating to the Services.
